Terms of service

Last updated October 20, 2026

These Terms of Service ("Terms") are a binding agreement between you and Hangar 31, LLC ("Hangar 31", "we", "us"), which operates Usician, including usician.app and every Local's portal (the "Service"). By creating an account, setting up a Local, or using the Service, you accept these Terms. If you don't accept them, don't use the Service.

Please read section 15 carefully. It requires disputes to be resolved by individual binding arbitration, waives class actions and jury trials, and limits the time to bring a claim.

1. Definitions

  • Local: a musicians' union local or similar organization that uses the Service.
  • Staff: people a Local gives office access to (owners, admins and employers).
  • Member: a person with an account in a Local's portal, including applicants.
  • Local Data: information a Local, its Staff or its Members put into the Service, including information about Members.

2. Who may use the Service

  • The Service is offered only in the United States, for Locals and people located in the United States. We make no representation that it is appropriate for use elsewhere.
  • You must be at least 13 years old. If you are under 18, you may use the Service only with the permission of a parent or legal guardian, who agrees to these Terms for you.
  • If you set up or manage a Local, you accept these Terms on the Local's behalf and confirm you are authorized to bind it. "You" then includes the Local.

3. The Service

The Service provides tools for membership records, applications, dues and payments, directories, work dues, rehearsal hall bookings, meetings and resources. The Service is in beta and changes often. We may add, change, suspend or remove any part of it at any time, with or without notice. We have no obligation to provide support, maintenance, updates or any particular feature. Any support we offer is at our discretion.

4. Accounts and security

  • Provide accurate information and keep it current. Keep your password, two-step sign-in device and backup codes secure.
  • You are responsible for everything that happens under your account. Notify your Local promptly if you believe your account has been compromised.
  • Each Local controls who can access its portal. We are not responsible for a Local's decisions about access, membership or account status.

5. Locals' responsibilities

Each Local is solely responsible for:

  • its Local Data: what it collects, its accuracy, and having all rights, notices and consents needed to put Members' information into the Service, including when importing members;
  • complying with all laws that apply to it and its Members, including federal and state privacy, data security, breach notification, consumer protection, and labor and union laws, and its own constitution and bylaws;
  • its dues, fees, coupons, policies, membership decisions and communications with Members;
  • reviewing what automations will do (the Service shows previews) before turning them on, and every charge, status change and email they produce;
  • choosing and removing its Staff, and everything its Staff do in the Service;
  • keeping its own copies of records it needs. Export your data regularly; the Service is not a records-retention system.

Insurance. We strongly encourage every Local to carry cyber liability or data protection insurance that covers the Member information it keeps. Hangar 31 does not insure Locals or Members against any loss.

6. Local Data

As between you and us, the Local owns its Local Data. You grant Hangar 31 a non-exclusive license to host, copy, process, transmit and display Local Data as needed to provide, secure and improve the Service, and to comply with law. We may use de-identified and aggregated information that doesn't identify any person or Local to operate and improve the Service. How we handle personal information is described in our Privacy Policy.

7. Payments between Members and Locals

Dues and fees are paid by Members to their Local, through the Local's own Stripe account and under Stripe's terms. Hangar 31 is not a party to those payments, does not hold or transfer funds, and is not responsible for charges, refunds, failed or duplicate payments, chargebacks, disputes, taxes or Stripe's services. Direct all payment questions to the Local.

8. Fees for Locals

The Service is free during the beta. We may introduce or change fees for Locals by posting them on our pricing page before they apply. Fees are non-refundable except where the law requires otherwise. Locals are responsible for any taxes on fees.

9. Acceptable use

You must not use the Service to:

  • break any law, or infringe or violate anyone's rights, including privacy rights;
  • send spam or unsolicited messages;
  • access accounts, Locals or data you aren't authorized to access, or probe, scan, test the vulnerability of, or overload the Service;
  • upload malicious code, or circumvent security, access controls or usage limits;
  • store Social Security numbers, full financial account numbers, health information, or other sensitive information the Service isn't designed for;
  • copy, resell or reverse engineer the Service.

10. Third-party services

The Service relies on third parties, such as Stripe for payments and email and hosting providers. Their services are governed by their own terms, and we are not responsible for them, including outages, errors, undelivered email or their handling of data.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate any account, portal or Local, or the Service as a whole, at any time and for any reason, including a violation of these Terms, risk to the Service or others, or a legal requirement, with or without notice. After termination we may delete Local Data and have no obligation to keep or return it. Sections 5 to 7 and 12 to 18 survive termination.

12. Disclaimers

The Service is provided "as is" and "as available", with all faults. To the fullest extent permitted by law, Hangar 31 disclaims all warranties, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, timely, secure, error-free or free of harmful components, that data will not be lost or corrupted, that email will be delivered, or that any calculation, automation, invoice, report or directory listing will be accurate.

13. Limitation of liability

To the fullest extent permitted by law: (a) Hangar 31 and its members, managers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, dues, data, goodwill or business, however caused and even if advised of the possibility; and (b) their total liability for all claims relating to the Service or these Terms will not exceed the greater of the fees the Local paid Hangar 31 for the Service in the 12 months before the event giving rise to the claim, or one hundred U.S. dollars ($100).

These limits apply to every theory of liability, including contract, tort (including negligence), strict liability and statute, and they are a fundamental part of the agreement between you and us.

14. Indemnification

You will defend, indemnify and hold harmless Hangar 31 and its members, managers, employees and contractors from all claims, losses, liabilities, damages, fines, costs and expenses (including reasonable attorneys' fees) arising from or related to: your use of the Service; your Local Data; your violation of these Terms or of any law; or any dispute between a Local and its Members, Staff, employers or others.

15. Dispute resolution: arbitration and class action waiver

  • Informal resolution first. Before starting any proceeding, you agree to email a written description of the dispute to support@usician.app and to try to resolve it informally for 60 days.
  • Binding individual arbitration. Any dispute, claim or controversy relating to the Service or these Terms, including their scope or enforceability, will be resolved by final and binding arbitration administered by the American Arbitration Association under its applicable rules, before a single arbitrator. The Federal Arbitration Act governs this section. Where the rules allow, the arbitration will be decided on written submissions or held by videoconference, without in-person hearings.
  • Class action and jury waiver. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party. You and Hangar 31 each waive the right to a jury trial.
  • Exceptions. Either party may bring an individual claim in small claims court, and either party may seek an injunction in court to protect intellectual property or to stop unauthorized access to the Service.
  • Time limit. Any claim must be brought within one year after it arises, or it is permanently barred.
  • Opting out. You may opt out of this arbitration agreement by emailing support@usician.app within 30 days after first accepting these Terms, with your name and a clear statement that you opt out of arbitration.
  • If the class action waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration, and the rest of this section still applies.

16. Governing law and venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of laws principles, except that the Federal Arbitration Act governs section 15. Any court proceeding permitted under these Terms will be brought exclusively in the state or federal courts located in Tennessee, and you consent to their jurisdiction.

17. Changes to these Terms

We may change these Terms at any time by posting the updated version here and updating the date above. Changes take effect when posted. Continuing to use the Service after that means you accept the changes.

18. General

  • These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
  • If any provision is unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect.
  • Our not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them without restriction.
  • We are not liable for delays or failures caused by events beyond our reasonable control.
  • You agree to receive notices electronically, by email or by posting in the Service.
